Are E Cigarettes legal?

Many countries around the world have placed a smoking ban on indoor locations. The E-cigarette however, does not contain any tobacco or produce any smoke so it does not fall under the smoking ban or other tobacco related laws. Because of this, they have been a cause of concern to some governments and tobacco companies because they are not subject to tobacco tax. Furthermore, because of illegal chinese imitations flooding the market, some countries have placed restrictions on sales until measures are put in place to regulate them.

Country Specific Laws:

  • In the United Kingdom, there are no restrictions placed on usage of electronic cigarettes.
  • In the United States, there are no restrictions placed on usage of the electronic cigarette since it does not contain any tobacco and therefore does not fall under the Clean Indoor Air Act.
  • In the European Union, there are no restrictions placed on usage of the electronic cigarette.
  • In the Netherlands, use of the electronic cigarette is allowed but advertising of it is banned.
  • In Australia, there is a ban on the sale of electronic cigarette cartridges in the province of Victoria. The ban only affects the cartridges, not the actual device. News Report
  • In Hong Kong, the sale of electronic cigarettes is banned
  • In Denmark, the sale of electronic cigarettes is legal, but there is a ban on the nicotine cartridges themselves
